GearOS Terms of Service (Plain English)

These Terms are the rules for using MaintenanceFreak. They are a contract between MaintenanceFreak LLC ("we") and you (the person or organization using the service).
They apply to:
If you create an account, install the app, click "Accept," or use the service, you are agreeing to these Terms.
1. Who can use the service
- You must be an adult (age of majority where you live) and able to enter into a contract.
- If you are using MaintenanceFreak for a company or organization, that organization is the customer, and you promise you have permission to agree to these Terms for it.
2. Agreeing online (and proof you agreed)
- When you check a box like "I agree" or click an "Accept" button, that counts as your electronic signature.
- We may keep records showing that you agreed (for example, the time and basic device or browser info) so we can prove what happened if there is a dispute.
- If we make big changes to these Terms, we may ask you to accept them again before you can keep using the service.
3. What the service does
GearOS is an asset and maintenance management platform. Depending on your plan and what is enabled, it can include things like:
- Assets and identifiers (like VINs or serial numbers)
- Maintenance tasks and schedules
- Documents and uploads
- Parts, tools, and inventory tracking
- Monitoring dashboards
- Inspections and templates
- Attestations and verification flows (sometimes using a token, code, or QR)
Some features can be turned on or off by plan, region, platform, configuration, or feature flags. We may change, remove, or add features over time.
4. Accounts, security, and tokens
- You must give accurate info when signing up and keep it updated.
- Some accounts require email verification, and verification links can expire.
- You are responsible for keeping your password, login tokens, API keys, and devices secure.
- Tell us right away if you think your account was accessed without permission.
Token-based access (API): The API uses bearer tokens and permissions. Token time limits can change, but a typical setup is:
- access tokens expire quickly (for example, 15 minutes)
- refresh tokens last longer (for example, 30 days) and can be rotated or revoked
Multi-factor authentication: MFA might be available, and some plans may require it.
Web session handling: For web traffic, we use secure cookie-based session handling (including anti-forgery token controls). Web access and refresh tokens are not stored in browser local storage.
5. Roles, permissions, and shared accounts
GearOS uses roles and permissions to decide who can see or change what.
- For some consumer plans, garages may use roles like captain, member, and viewer. Captains manage invites and roles.
- For pro plans, access can be based on subscription memberships and RBAC-style permissions (and garage roles might not apply).
If you invite other people, you are responsible for what they do with the access you give them. Keep roles tight and appropriate.
If you belong to multiple subscriptions, switching context can change what you can see and do. Make sure you are working in the right context.
6. Beta features
If we label something beta, preview, or experimental:
- It might be incomplete or change quickly.
- It can break.
- It can be removed.
- Do not rely on it for critical operations.
7. Subscriptions, billing, renewals, and limits
- Paid plans can auto-renew unless you cancel.
- Buying a subscription means you approve recurring charges.
If you bought through Apple or Google
- Apple App Store or Google Play controls billing, renewal, cancellation, and refunds under their policies (except where the law requires something different).
If you bought through our website
- Payments are usually processed by a payment processor (like Stripe).
Pricing and plan changes
- We can change prices or plan features with notice. Usually changes apply at your next renewal.
Limits and fair use
We can enforce limits like:
- storage limits
- upload size and file type limits
- rate limits (throttling)
- plan-based caps on features
If you go over a limit, requests can fail, slow down, or be blocked.
Assistant or AI feature limits (if offered)
If you use assistant or AI-enabled features, your plan may cap usage. Example monthly limits:
- B0: 3
- P tiers: 20
- S tiers: 50
- O and M tiers: 1000
- X tiers: 3000
These limits can change if your plan changes or we update the service.
Refunds
Refund and trial rules (if any) are shown at checkout or in the app store listing and apply here too. Some places have legal refund rights that also apply.
8. Your content and uploads
You own what you upload (documents, images, and other files).
To run the service, you give us permission to:
- store your content,
- process it,
- send it,
- display it,
- and make technical copies (like thumbnails),
only for running, securing, and improving the service and complying with the law.
You promise:
- you have the rights to upload what you upload, and
- it is legal and not infringing.
We can reject or remove content that is illegal, infringes rights, violates policy, or creates risk.
9. Rules for using the service
Do not:
- hack or bypass security, permissions, or rate limits
- reverse engineer the app or service (except where law allows)
- scrape or harvest data at scale without permission
- upload malware
- violate laws
- try to access data or accounts you do not have permission to access
If you do, we can suspend or terminate your access.
10. Connected devices (BLE, Wi-Fi) and safety
Some mobile features may interact with devices over Bluetooth or Wi-Fi (depending on what is enabled).
- You are responsible for safe use.
- We do not guarantee every device will work or stay connected.
- Pairing and provisioning can fail for reasons outside our control (environment, firmware, OS updates, etc).
11. Attestations and verification flows
Attestation flows can be public in the sense that anyone with the token, link, or QR code can access them.
- Treat those links and codes like secrets.
- Do not submit false or misleading attestations.
- Evidence uploads can be limited to certain types (like images or PDFs) and sizes.
- We may rate-limit or block submissions if we see abuse or risk signals.
- Some attestation records may be designed to be permanent (immutable) for integrity and fraud prevention, even if tokens expire.
Attestation results may be shared with the requester, asset owner, or other authorized parties as part of how the flow works.
12. Public profiles
If you turn on public profile settings, some of your info can become public (and possibly shareable by link). You are responsible for what you choose to publish.
Turning something off might not instantly remove copies from caches or archives outside our systems.
13. Third-party services
We rely on third parties to make the service work (and some features send data to them). Examples can include:
- app stores (Apple, Google)
- payments (Stripe)
- email delivery (SendGrid)
- cloud infrastructure (AWS, including S3 storage and SQS queues)
- push notifications (APNs, Firebase Cloud Messaging)
- maps and places (OpenStreetMap tiles, Google Places)
- OAuth login providers (like X)
Those providers can have outages or changes. We are not responsible for their failures to the maximum extent allowed by law.
14. Privacy policy
Our Privacy Policy explains how we handle personal data. It is part of this agreement (to the extent the law allows).
15. Suspension, termination, and your responsibility to back up data
We can suspend or terminate access if:
- you break these Terms,
- you do not pay,
- your account creates a security or fraud risk,
- you submit false attestations, or
- you try to bypass limits or controls.
You can cancel anytime. Cancellation stops future renewals, but does not automatically refund past charges unless required by law or an explicit refund policy says so.
Important: MaintenanceFreak is not a backup service. If something is critical, keep your own backups.
16. Disclaimers (the legal "no promises" part)
- The service is provided "as is" and "as available."
- We do not promise the service will be uninterrupted, error-free, or always available.
- Reminders, analytics, and assistant outputs are informational only. You are responsible for maintenance decisions, safety, and compliance.
17. Limits on liability
To the extent the law allows:
- We are not liable for indirect or consequential damages (like lost profits or business interruption).
- Our total liability is capped at the fees you paid us in the [INSERT: X] months before the event that caused the claim.
Some places do not allow certain limits, so these limits apply only as far as the law allows.
18. You cover us if your actions cause a claim (indemnity)
If someone brings a claim because of:
- your content,
- your misuse of the service,
- your violation of the Terms or law, or
- your infringement of someone else’s rights,
you agree to cover the Company’s costs and losses (including reasonable attorneys’ fees).
19. Our intellectual property
We own the service itself (the software, design, branding, etc). You get a limited license to use it as intended, under these Terms and your plan.
20. Arbitration, class action waiver, and jury trial waiver
Governing law: Illinois, United States.
Venue for court matters (when court is allowed): Will County, Illinois.
First, try to fix it with us. Before either of us files anything, you agree to contact us and tell us what happened and what you want. Email legal@maintenancefreak.com (or mail us at the address in the "Contact" section). If we cannot resolve it within 30 days after we get your notice, then either side can move forward.
Most disputes go to arbitration, not court. Except for the exceptions below, you and MaintenanceFreak agree that disputes related to these Terms or the Service will be decided by binding arbitration (one neutral arbitrator), not by a judge or jury in court. This also includes fights about whether this arbitration section applies.
This is covered by U.S. arbitration law. The Federal Arbitration Act (FAA) controls this arbitration agreement.
Exceptions (things that can still go to court).
Small claims: Either of us can bring an individual claim in small claims court (if it qualifies).
Emergency or "stop it now" situations: Either of us can go to court to quickly stop or prevent:
- unauthorized access to the Service, accounts, or data,
- abuse or attacks on the Service, or
- stealing or misusing intellectual property or confidential information.
Who runs the arbitration and what rules apply.
- If you are using MaintenanceFreak mainly as a personal consumer, AAA's Consumer rules apply.
- Otherwise (business use), AAA's Commercial rules apply.
- If AAA will not take the case, we will use JAMS instead.
- If neither AAA nor JAMS is available, then the dispute goes to the courts listed in these Terms, and the "no class actions" rule below still applies as much as the law allows.
Where it happens.
- If you are a consumer, you can choose: video, phone, documents-only (if allowed), or in-person in your home county.
- Otherwise, the arbitration is in Will County, Illinois.
- The arbitrator can allow remote hearings when it makes sense.
Costs.
- Each side normally pays its own lawyer costs (unless a law says otherwise and the arbitrator awards fees).
- If you are a consumer, we will pay or reimburse the arbitration fees when the AAA consumer rules (or the law) require it.
- We will not try to make you pay arbitration fees we are required to pay unless the arbitrator says your claim was frivolous.
What the arbitrator can do. The arbitrator can award the same kinds of remedies a court could award under the law, but only to solve your individual dispute. No one gets relief for people who are not part of the case.
No class actions. You and MaintenanceFreak agree:
- no class actions,
- no class arbitration,
- no collective actions,
- no representative actions (including private attorney general actions).
No jury trial. Arbitration means no jury. If a claim ends up in court for a legal reason, you and MaintenanceFreak still waive the right to a jury trial as much as the law allows.
Opt-out (optional). You can opt out of arbitration within 30 days of first accepting these Terms. Email legal@maintenancefreak.com (or mail the address in "Contact") with your name, your account email, and a clear statement that you want to opt out. If you opt out, disputes will be handled in court as described in these Terms.
If part of this section is invalid. If the "no class actions" part cannot be enforced, the arbitration requirement is void only as far as the law requires. Everything else stays in place.
21. App store notes
- If you got the iOS app from Apple, Apple is not the provider of the service, and billing and refunds go through Apple’s rules.
- If you got the Android app from Google Play, billing and refunds follow Google’s rules.
